The Technological Wonders Of A Genealogy DNA Test

Is the child yours?

Years ago, you'd have to go through countless hours of introspection and serious computation just to ensure the paternity of a child. Though this isn't a common occurrence, since most of the time, people do acknowledge the child as theirs, parties who find themselves in dispute over their parenthood of a child do have to endure a difficult ordeal in proving, or disproving, legitimate or natural filiation. Such is the matter in cases involving child support, successional rights, and certain grounds for divorce.

Nowadays, technology has progressed to the point that the human genetic signature has been discovered and is in fact being used to ascertain natural relationships between subjects. We're talking about DNA, that unique strand that populates every cell, a matchless mark that we individually possess, and some of its traits we share with people of the same direct lineage. Indeed, through the wonders of a genealogy DNA test, we can validate parent-child relationships with scientific conclusiveness. Such findings, if ever they are arrived at, would be indubitable. They are 100% foolproof. They leave no errors for mistakes.

But scientific findings are very much different when compared to legal determinations of facts. In courts of law, the results of a genealogy DNA test only establish a prima facie case for the presence or absence of filiation. It is conclusive, but refutable nonetheless. It carries a lot of evidentiary weight, however, and often, it will be difficult to overcome the presumption it creates.

The courts of law do not automatically admit the results of a genealogy DNA test. Home tests, for example, are generally held as inadmissible, considering the chain of custodies they have passed through before arriving at the possession of the court. The law would like to preserve the integrity of the samples and its conclusions, and the lengthier the chain of custodies is, the higher the possibility that tampering was made. Hence, the law limits the chain of custodies involved with the delivery of the genealogy DNA test sample before it can be admitted as evidence in the proceedings.

Indeed, if you have doubts about your parenthood over a child, or if you have claims over a child which you want to uphold, you won't have to rely on testimonies, both yours and hostile, to prove your assertions. You can resort to science, and science will provide a determinative validation of your stance.
